General rules

HitPay has strict guidelines regarding the businesses, products, and services that we deem to be prohibited or restricted from using HitPay’s Services. This Acceptable Use Policy sets out the terms under which you may access our Services and applies as soon as you access and/or use HitPay.

You must be aware that our platform may be used internationally; hence, the sale of certain items may be prohibited by laws outside of the country in which you are based. You agree that it is your sole responsibility to comply with the relevant laws.

The types of businesses listed below are representative, but not exhaustive. Businesses that offer illegal products or services are never eligible to use HitPay. While this list is representative, it is not exhaustive, and we reserve our right to deny our services to any customers who exceed our risk tolerance and reserve our right to impose additional restrictions.

Terms of Service

You may not use HitPay for products or services that:

  1. in any way breaches any applicable local, national, or international law or regulation, or causes HitPay to breach any applicable law or regulation;
  2. are in any way unlawful or fraudulent, or has any unlawful or fraudulent purpose or effect;
  3. are for the purpose of harming or attempting to harm minors in any way;
  4. are discriminatory, derogatory in any way, or encourage violence, hatred or religious or racial intolerance;
  5. are sexual in nature;
  6. are involved in human trafficking, child labor and prostitution;
  7. deal in harmful programs such as viruses, spyware, or similar computer code designed to adversely affect the operation of any computer software or hardware;
  8. are investment interests such as bonds, stocks, or other securities;
  9. are related to lottery, gambling, or contests;
  10. in any way that would locally or internationally evade any applicable taxes or facilitate tax evasion.

Prohibited Businesses: These will not be allowed or supported by HitPay

i. Illegal products and services

  • Any business or organization who provides products and/or services that are discriminatory, derogatory in any way, or encourage violence, hatred or religious or racial intolerance; terrorism
  • Products and/or services that constitute a form of drugs (whether medical of nature or not), including but not limited to steroids, narcotics, cannabidiol products, prescription drugs or other controlled substances on our Platforms;
  • Products and/or services that involve the re-sale of personal information, including but not limited to application forms that contain personal information;
  • Fake references and other services/products that foster deception (including fake IDs and government documents)
  • Products such as devices that are designed to block, jam or interfere with cellular and personal telecommunication device/signals (e.g. GPS), Decryption and descrambler products including mod chips, Spy devices / services / software.
  • Firms involved in the sale of prohibited animal and animal products such as endangered species, elephant ivory, etc
  • Any other Products and services which are not legal in the jurisdiction they are being offered in

ii. Intellectual Property Infringement

  • Counterfeit goods/replicas or those infringing on intellectual property rights, including those designed to infringe on such intellectual property (i.e., knock-offs, imitations, bootlegs)
  • Sales or distribution of music, movies, software, or any other licensed materials without appropriate authorization
  • Unauthorized sale of brand name or designer products or services
  • Any other products or services that directly infringe or facilitate infringement upon the trademark, patent, copyright, trade secrets, proprietary or privacy rights of any third party

iii. Products and services that are unfair, predatory, or deceptive

  • Offering or disseminating fraudulent goods, services, schemes or promotions, such as make-money-fast schemes
  • Pyramid schemes and selling
  • Merchants engaged in any form of deceptive marketing practices including but not limited to:
    1. Hidden Disclosures
    2. Fake claims & endorsements
    3. Pre-checked opt in boxes
    4. Refund/Cancellation avoidance
    5. Poorly disclosed negative options
    6. Negative response marketing
  • Sales of online traffic or engagement such as social media “click farms”
  • Any other businesses that HitPay considers unfair, deceptive, or predatory towards consumers

iv. Adult entertainment and content

  • Adult entertainment, including prostitution, escorts, pay-per-view, sexual massages, fetish services, mail-order brides, and adult live-chat features, gentleman’s clubs, topless bars, strip clubs, sexually oriented dating sites or services
  • Adult content, including books, magazines, audio, videos, websites, streaming services and other content formats deemed offensive or of a sexual nature depicting nudity or explicit sexual acts
  • Products relating to adult entertainment in any form is strictly prohibited in Malaysia and Indonesia.

v. Legal services

  • Bankruptcy attorneys
  • Bail bonds

vi. Weapons, firearms, explosives and dangerous materials

  • Firearms, explosive devices, ammunition, weapons, guns, rifles, shotguns, pistols, knives or other sanctioned items and/or investments relating to the same;
  • Peptides, industrial and research chemicals, and other toxic, flammable and radioactive materials.

vii. Betting and gambling or transactions involving games of chance

  • Products and/or services that promote illegal activities or relate to the gambling business, including casinos, online gambling, lotteries, games of chance, sports forecasting or odd-making.

viii. Marijuana-related products and services

  • Cannabis products
  • Cannabis dispensaries and related businesses
  • Products containing any amount of CBD/THC
  • Any other products or services related to legal marijuana trade

x. Financial and Professional Services

  • Bearer share entities
  • Shell banks
  • Unlicensed banks and/or non-bank financial institutions
  • Unlicensed investment and brokerages services
  • Unlicensed financial advisors and/or agents

xi. Digital Assets and Cryptocurrencies

  • Products and/or services that constitute a form of currency including but not limited to,virtual and cryptocurrencies, crypto assets, non-fungible tokens (NFTs), and mining services, and other forms of digital tokens such as Bitcoin and Ethereum;

xii. Others

  • Commercial airlines and cruises, charter and private airlines
  • Illegal timeshare services in Singapore and Malaysia

Restricted Businesses: These may require further documentation or further review before accounts can be fully opened for transactions

HitPay will review the application and approve restricted business categories on a case-by-case basis. Additional restrictions on business areas may be imposed through card network rules, requirements of financial partners, or due to compliance and legal obligations.

  1. Regulated industries such as:

i. Financial products and services

  • Lending and Buy Now Pay Later services
  • Crowdfunding platforms
  • Debt collection agencies
  • Insurance services
  • Money transmitters, remittances, currency exchange services, and other money service businesses
  • Trust companies
  • External asset managers
  • Security brokers/investments of any kind
  • Other financial institutions

iii. Pharmaceuticals, medical devices, and regulated health products

  • Online pharmacies
  • Prescription-only products including card-not-present pharmaceuticals
  • Prescription-only and regulated medical devices
  • Health, medical and aesthetic products that must be licensed and approved by corresponding registries such as HSA in Singapore

iv. Alcohol and liquor businesses

  • Alcohol and liquor-related products or services must have corresponding licenses for retail sale or clearances on selling beyond usual hours

**v. Tobacco and other smokable products **

  • Tobacco products, cigarette substitutes and e-cigarettes, and e-liquids, including but not limited to cigarettes, cigars, pipes and chewing tobacco.
  1. Businesses that may pose elevated risks such as:

i. Travel and Tourism

  • Travel and tour reservation and booking services
  • Private hire or limousine services

ii. Government or public services

  • Government payments, service delivery or grants
  • Embassy, foreign consulate, or other foreign governments

iii. High Value Goods and Luxury Items

  • Sale of high value items such as luxury goods, jewellery, car dealerships, collectibles, art pieces, precious stones and metals, artifacts and antiquities.

iv. Charities and non-profit organisations

  • Religious, charities, societies and other associations

v. Other business activities

  • Dropshipping
  • Real estate and construction
  • Corporate service providers, who assist in the formation and incorporation of companies
  • Products and services related to online gaming industry such as sale of gaming credits
  • Shipping and trade activities such as shipping brokers, forwarding brokers
  • Aggregators, including but not limited to marketplaces, platforms
  • Import, export of wholesale goods
